FDA probes 5 deaths for possible ties to Monster Energy drink

Monster is the plaintiff of a case filed by the family of a 14-year-old girl who died after drinking two cans of its Monster Energy drink in a 24-hour period.

Monster, the largest energy drink in the United States and brand by volume, vowed to defend itself strongly against a lawsuit alleging that its drinks fatally exacerbated a 14-year-old girl’s pre-existing heart disorder. FDA already received reports of five deaths and one heart attack with alleged ties to Monster Energy drinks between 2009 and June 2012.

The U.S. Food and Drug Administration said last Monday that it is investigating reports of five deaths that allegedly tie up with Monster Beverage Corp.’s energy drink which caused the company’s share to fall more than 14 percent.

The family of a 14-year-old girl who died after drinking two cans of its Monster Energy drink in a 24-hour period is the latest to sue the company.

The management of Monster does not believe its drinks have anything to do with the girl’s death.

The company said in a release said that it is unaware of any fatality that could be attributed to their drink and that they intend to defend themselves against the lawsuit.

Anais Fournier’s family has filed a lawsuit last Friday against Monster for failing to warn consumers about the product’s dangers.
According to the lawsuit which was filed in California Superior Court in Riverside, after drinking two 24-ounc cans of Monster Energy on two consecutive days, Fournier suffered a cardiac arrest and died two days later on Dec. 23, 2011. The complaint stated that the cardiac arrhythmia was due to caffeine toxicity that complicated a heart disorder she already had.

FDA spokeswoman Shelly Burgess said that from 2009 through June this year, they have received reports of five deaths and one heart attack that were blamed on Monster Energy drink.
FDA said that it investigates any report of injury or death that it receives.

Monster leads the U.S. energy drink by volume and has 39 percent of the U.S. market, but Austria’s Red Bull has the highest share by revenue due to its premium price.

In July, three energy drink companies received subpoenas from the New York’s attorney general’ Subpoenas were sent to Monster, PepsiCo and Living Essentials LLC. PepsiCo manufactures AMP energy drink and Living Essentials have 5 Hour Energy.
