September 10 of last year, Zack Nelson, 17 years old, died when Steven L. DiCenzo allegedly crashed his Honda Civic into a tree on Hardy Boulevard at the Farmington resort. The BAC of DiCenzo was .136 percent, according to test given by the police.
The suit was filed against the resort, its owner Joe Hardy, his daughter and the teen that was driving the car by parents of the Chalk Hill teen who died when a drunken driver hit a tree at Nemacolin Woodlands Resort last
Daniel and Tricia Nelson, parents of Nelson, alleged in the lawsuit filed in Fayette County Court that Hardy has knowledge or should have known that his daughter, Paige Hardy had a party which served alcohol to her visitors who were mostly minors. They alleged that Joe Hardy, the father of Paige did not do a thing to stop minors from drinking.
In the Nelsons’ suit, they claimed that Paige Hardy served DiCenzo alcohol, including whiskey and rum, during the night of the accident.
According to the police, the mishap happened around 10:50 that night. DiCenzo, Zachery Nelson, Paige Hardy and three other teenagers were all in the vehicle at the time. Two passengers, Paige Hardy and Gabrielle Cellurale were both injured in the crash.
DiCenzo, the operator, received the following charges: homicide by vehicle while driving under the influence of alcohol, aggravated assault while DUI, DUI and other various offenses, but since he was only 17 at the time, the hearing of the case was done in juvenile court.
Last March, upon the recommendation of Senior Judge Conrad B. Capuzzi a juvenile probation officer, DiCenzo was ordered to be confined at the Gateway Rehabilitation Center in Aliquippa for 45 days to undergo counseling & therapy for post-traumatic stress disorder, drug and alcohol issues.
DiCenzo was required 180 days on electronic monitoring and to perform 50 hours of community service.
He could be losing his driver’s license for up to eight years.
The spokesperson for Nemacolin Woodlands and 84 Lumber Co., did not issue any comment as the case is now an issue of litigation.
